To prevent unauthorised access, maintain data accuracy, and ensure the correct use of information, Ice Warrior Expeditions Ltd. has used appropriate industry standard procedures to safeguard the confidentiality of Your personal information. However, no data transmitted over the Internet can be 100% secure. As a result, while we strive to protect your personal information, Ice Warrior Expeditions Ltd. cannot guarantee the security of any information that you transmit to us or from our sponsors and you do so at your own risk.


This Agreement constitutes the entire Agreement between You and Ice Warrior Expeditions Ltd. in connection with general registration on the Global Warrior Basecamp website and supersedes all prior agreements between the parties regarding the subject matter contained herein. If any provision of this AGREEMENT is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of this AGREEMENT will remain in force. No failure of either party to exercise or enforce any of its rights under this AGREEMENT will act as a waiver of such rights.


INTELLECTUAL PROPERTY INFRINGEMENT CLAIMS
It is the policy of Ice Warrior Expeditions Ltd. to respond expeditiously to claims of intellectual property infringement. We will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws. Notices of claimed infringement should be directed to jim@ice-warrior.com.

In these terms, “we,” “us” and “our” mean Ice Warrior Expeditions Limited, trading through Global Warrior Basecamp. “You” and “your” mean the person purchasing products from us.

2. These terms

These Terms and Conditions of Sale apply to purchases of physical products made through the Global Warrior Basecamp website.

They do not apply to expeditions, consultancy, subscriptions, sponsorship arrangements, donations or services. Separate terms may apply to those activities.

Please read these terms before placing an order. By placing an order, you confirm that you have read and agree to them.

Nothing in these terms affects your statutory consumer rights.

Our contract with you will be in English. You may save or print a copy of these terms for your records.

3. Placing an order

The website allows you to review your basket and correct errors before submitting an order.

When you select the final payment or order button, you are placing an order with an obligation to pay. The total price, including available delivery charges, will be displayed before you submit the order.

After receiving your order, we will send you an acknowledgement by email. This acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it.

We accept your order when we send you a dispatch confirmation or otherwise expressly confirm that the order has been accepted. At that point, a contract is formed between you and us.

Each dispatch confirmation forms a separate contract for the products identified in that confirmation.

4. When we cannot accept an order

We may be unable to accept an order because:

  • A product is unavailable

  • We cannot obtain authorisation for payment

  • We do not deliver to your address

  • A product or price was incorrectly displayed

  • You do not meet an eligibility requirement disclosed on the website

  • We suspect that an order is fraudulent, unlawful or intended for unauthorised resale

  • We have identified an error in the product description or applicable delivery information

If we cannot accept your order, we will notify you and refund any payment already taken for products we cannot supply.

5. Products and descriptions

We take reasonable care to ensure that product descriptions, specifications, prices and photographs are accurate.

Images are provided for illustration. Colours can appear differently depending on a device’s display, and product packaging may vary from that shown. Any variation will not affect your statutory right to receive goods that are as described, of satisfactory quality and fit for their intended purpose.

Measurements, weights and dimensions may be approximate unless expressly stated otherwise.

Some product information may be supplied by the manufacturer. If you need a product for a particular purpose, please contact us before ordering so that we can help confirm its suitability.

6. Safety-critical products

Certain products, including climbing equipment, helmets, stoves and other technical outdoor equipment, must be selected, maintained and used correctly.

You are responsible for:

  • Reading and following all manufacturer instructions and warnings

  • Obtaining suitable training where necessary

  • Inspecting equipment before use

  • Ensuring that the product is suitable for the intended activity and user

  • Not using equipment that is damaged, altered, recalled or beyond its recommended service life

Nothing in this section excludes or limits our responsibility for supplying goods that are safe, of satisfactory quality, fit for purpose and as described.

7. Prices

All prices are shown in pounds sterling.

Prices include VAT where applicable. Delivery charges and any other unavoidable charges will be displayed before you place your order.

We may change prices at any time, but changes will not affect orders we have already accepted.

If the price shown for a product is an obvious and unmistakable error that you could reasonably have recognised as incorrect, we may cancel the order and refund any amount paid.

8. Payment

Available payment methods are displayed during checkout. We must receive authorised payment before products are dispatched.

You confirm that you are authorised to use the payment method provided.

We will not add optional charges or extras without your express consent. If a payment is refused, reversed or cancelled, we may suspend or cancel the order.

9. Promotions and discount codes

Promotions and discount codes are subject to any additional conditions stated with the offer.

Unless we state otherwise:

  • A discount code may only be used once per order

  • Discount codes cannot be exchanged for cash

  • Discount codes cannot be used after their expiry date

  • Only one discount code may be used per order

  • Discounts do not apply to delivery charges

  • Promotions are subject to availability

We may withdraw or correct a promotion where there has been an obvious error, fraud or misuse. This will not affect an order already accepted unless the promotional price was clearly an error that should reasonably have been recognised.

10. Availability

All products are subject to availability.

Placing an item in your basket does not reserve it. If a product becomes unavailable after you order, we will contact you and refund the amount paid for that product.

We may limit the quantity of a product that can be purchased where reasonably necessary, including for scarce products or suspected unauthorised resale.

11. Delivery

Available delivery destinations, methods, costs and estimated delivery times will be displayed on the website or during checkout before you place your order.

We normally aim to dispatch orders within three to five working days unless a different dispatch time is shown on the product page or during checkout.

A dispatch estimate is not necessarily the date on which the order will arrive. Any applicable transit time will be shown separately.

We will deliver the products within the period agreed with you. If no period has been agreed, we will deliver without undue delay and normally within 30 days after the contract is formed.

Delivery may be made in separate consignments at no additional cost unless otherwise agreed.

You are responsible for providing a complete and accurate delivery address. Please contact us promptly if you discover an error.

12. Delivery delays

If delivery is delayed by circumstances outside our reasonable control, we will contact you as soon as reasonably possible and take reasonable steps to minimise the delay.

If there is a substantial delay, or delivery by an agreed date was essential and we fail to meet that date, you may have the right to cancel the contract and receive a refund for products not received.

13. Failed delivery

If nobody is available to accept delivery, the carrier may leave instructions explaining how to rearrange delivery or collect the parcel.

If a parcel is returned to us because:

  • The address supplied was incorrect or incomplete

  • Delivery or collection was repeatedly unsuccessful

  • You did not collect it within the carrier’s stated period

we will contact you. We may charge reasonable additional delivery costs before sending the order again, except where the failed delivery was our fault or the carrier’s fault.

14. Responsibility for and ownership of products

A product becomes your responsibility when it is delivered to you or to a person you have nominated to receive it.

Ownership of the product passes to you once we have received payment in full.

If you arrange for a carrier that was not offered by us to collect the product, responsibility may pass to you when the product is handed to that carrier.

15. Cancelling before dispatch

If you wish to cancel an order before dispatch, contact us as soon as possible at info@global-warrior.com.

We will try to stop the order, but we cannot guarantee that cancellation will be possible once processing or dispatch has begun.

If the order has already been dispatched, you may exercise any applicable statutory cancellation rights after receiving it.

16. Online cancellation rights

For most products purchased online, consumers have a statutory right to cancel without giving a reason.

You must notify us within 14 days after the day on which you, or a person nominated by you, receives the goods. Where one order is delivered in separate consignments, the cancellation period begins after the final item is received.

After notifying us, you normally have a further 14 days to return the products.

You are responsible for the direct cost of returning change-of-mind purchases unless we state otherwise. We will refund the least expensive standard delivery charge where an entire order is cancelled. Additional amounts paid for express or premium delivery are not normally refundable.

17. Climbing equipment and helmets

Due to safety considerations, climbing equipment—including harnesses, ropes and climbing hardware—and helmets cannot be returned or exchanged under our voluntary returns policy.

This restriction does not affect:

  • Statutory cancellation rights that apply to eligible online purchases

  • Your rights concerning faulty, unsafe, misdescribed or unsuitable goods

  • Any other rights that cannot legally be excluded

18. Faulty or misdescribed products

We have a legal duty to supply products that conform to the contract. Products must be as described, of satisfactory quality and fit for their intended purpose.

If a product is faulty, damaged, unsafe, misdescribed or not fit for purpose, contact us as soon as possible.

Depending on the circumstances and applicable law, you may be entitled to a refund, repair, replacement or price reduction. We will pay or reimburse reasonable return costs where we are legally responsible for the return.

A manufacturer’s warranty is additional to, and does not replace, your statutory rights.

19. Refunds

Approved refunds will be issued to the original payment method unless otherwise agreed.

For eligible online cancellations, refunds will normally be issued within 14 days after we receive the returned products or receive satisfactory evidence that they have been sent back, whichever occurs first.

We may reduce a refund to reflect a loss in value caused by handling beyond what is reasonably necessary to establish a product’s nature, characteristics and functioning.

20. Our responsibility for loss or damage

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We do not exclude or limit liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Breach of your statutory consumer rights

  • Defective products where liability cannot legally be excluded

We are not responsible for losses that were not foreseeable when the contract was formed.

Products sold under these terms are intended principally for private use. If you use a product for commercial, business or resale purposes, we will not be responsible for loss of profit, revenue, business, contracts, opportunity or business interruption, except where liability cannot legally be excluded.

21. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control.

These may include severe weather, natural disasters, transport disruption, industrial action, epidemics, failures of telecommunications or utilities, import or export restrictions, governmental action or disruption affecting suppliers and carriers.

We will contact you where practicable and take reasonable steps to reduce the effects of the event. Your statutory rights concerning significant delay or non-delivery remain unaffected.

We process personal information in accordance with our Privacy Notice.

We use order information to process payment, fulfil orders, communicate with you, prevent fraud and comply with legal obligations.

24. Changes to these terms

We may update these terms from time to time.

The terms applying to an order are those available when the order is placed. Changes will not apply retrospectively to an order already accepted unless required by law or agreed with you.

25. Transfer of rights

We may transfer our rights and obligations under the contract to another organisation where this does not adversely affect your rights.

You may only transfer your rights or obligations with our written agreement, except where the law allows otherwise.

26. Severability

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

27. Waiver

If we do not immediately enforce a right under these terms, that does not mean that we have waived it.

28. Third-party rights

The contract is between you and us. No other person has a right to enforce it, except where the law provides otherwise.

29. Governing law and courts

These terms and any contract between you and us are governed by the law of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you retain the benefit of any mandatory consumer protections applicable where you live. You may bring legal proceedings in the courts of the part of the United Kingdom in which you live.
